It's pretty much assumed the NCAA will never use the death penalty again after seeing what happened to SMU.

Not that this is in any way an apples to apples comparison, but there are two things that dispute this:

 

1 - The death penalty didn't exactly kill Kentucky basketball after it was used on it in 1952.

2 - The death penalty has been used twice since SMU (albeit in D2, and not in a major sport).

And Kentucky went back to being the dirtiest program this side of Kansas after that, was caught and did not get the death penalty.

There's really not much more to indicate a university-wide "look the other way" than this case. As he said, do a background check or hire a PI for one day and you could have had all the information needed to sever ties and report yourself to get off easily.

 

He's leading the team on the field multiple times, handing the hoops coach and University president a $50K check in a public function, hanging out with coaches and players all over town in a visible setting and trying to fight the compliance guy in the press box as witnessed by many. And through all of this, no one even bothered to check that this young, flashy rich dude was working with an agency that hired UM players?

 

well yeah, they probably didn't want to know. nobody's arguing that they shouldn't be punished if the information in the yahoo article is accurate. the question is how severely they should be punished.

 

I wasn't meaning to argue with anyone or disagree with what has been said. I was just finally able to read the whole thing and basically marveling at how outrageous it is .

What is likely to be the worst for UM is that after the fight, a background check was performed on Shapiro and it came to light he was an agent and nothing was done about it to keep him away. That's where the admin comes into play and LOIC gets thrown around. Also, there are rumors that Hocutt knew what was going on.

 

Off the subject, but why can't the ACC teams get it right when they buy players? UNC, UM, and GT have all been busted for this recently, and none have even been in a BCS bowl related to the trouble while Oregon, Auburn, USC, etc. are playing for titles. Get it together, ACC!

I don't think anyone has ever thought of Hester as being somewhat intelligent.

Agreed. I just find it ironic that he's the only one "smart enough" not to talk about it.

Someone explain to me how these guys are getting off scott free? They got meals, hotel rooms. Arthur Brown allegedly got cash payments. All from a school's booster. Yet they're in the free and clear? How is this different from Josh Selby taking $ from a family friend? Or Jake Pullen/Curtis Kelly, all who got suspended? What about Dez Bryant? All he did was lie about where he ate lunch, and he was forced to sit out the whole year.

 

 

MANHATTAN, Kan. -- Kansas State said Wednesday it has been assured the NCAA has no concerns about the eligibility of two Wildcats football players identified by a jailed University of Miami booster as recipients of improper gifts.

Nevin Shapiro, a 42-year-old Miami resident sentenced in June to 20 years in federal prison for running a $930 million Ponzi scheme, told Yahoo! Sports he provided cars, cash, prostitutes and other impermissible benefits to 72 athletes.

Shapiro's list included Bryce and Arthur Brown, brothers from Wichita now in their first year of eligibility at Kansas State.

Shapiro said he paid for lunch and hotel rooms for the brothers, their parents and spiritual adviser when they visited Miami in March 2008.

Arthur Brown was already enrolled by then at Miami and played two years at linebacker before transferring to Kansas State. Bryce was a sophomore running back at Wichita East considered one of the nation's top prospects; he committed to Miami but played a year at Tennessee before also transferring to Kansas State.

Kansas State issued a brief statement Wednesday night saying it had been in communication with the NCAA.

"Regarding Arthur Brown and Bryce Brown, the NCAA staff has informed the institution that it has no concerns about their eligibility to compete at K-State," the university said, adding it would not comment further.

The Browns' spiritual adviser, Brian Butler, told The Wichita Eagle that he and the Browns didn't know Shapiro was a Miami booster. Instead, they thought Shapiro was just a fan who helped players from out of state.

"In our case, he did invite us to lunch and we did go to lunch, and he did reserve some rooms for us, for myself and Mr. Brown senior," Butler told the newspaper. "Those things, I can say that he did."

Butler added that Shapiro "wasn't giving us money and trying to pay us or bring Bryce or Arthur there, Arthur was already at the school."

Phone and text messages left Wednesday with Butler by The Associated Press were not returned.

Both brothers had to sit out last season because of NCAA transfer rules.

Shapiro pleaded guilty in June to securities fraud and money laundering. In addition to a 20-year prison term, he was ordered to pay more than $82 million in restitution. He told Yahoo! Sports that he gave money and gifts to players, paid for nightclub outings, sex parties and in one case an abortion for a woman impregnated by a player.

Supposedly part of why SMU went into the toilet for so long too is because even after the program was back, the school imposed such high academic and other such standards on football players that it proved pretty much impossible to compete.

Least likely sanction to happen, since it penalizes the teams they play. NCAA has stated as much as this won't happen again, but they may limit revenue for the team under sanctions.

Of course, we now know the real motivation for that speech was a $5k bonus from Shapiro for playing hurt in the second half.
