So some cop friend of Patrick Kane tampered with the evidence in order to trash the victim's reputation but actually just weakened Kane's defense? What sort of sense does that make? Hence, if I'm her attorney I handle whatever allegations behind the scene, not call a press conference and make half-assed accusations of impropriety.

 

So Kane can have a press conference about this, but the victim can't?

 

How does it benefit the victim's case to throw a press conference to complain in public (before handling in private) about some idiot criminal cop allegedly invalidating what would have probably been one of the core pillars of Kane's defense?

 

She can throw a press conference every day for all I care, but I don't understand why her lawyer is taking this particular approach.

To get another law enforcement agency, FBI / State Police to look at how this case is being handled/mishandled by the local police dept. If that was slow to happen, this is a way to put public pressure on them.

To me it's most likely this is some sick prank that duped the attorney.

 

How in the world could the PD or DA or whoever holds such evidence, allow for the missing rape kit to be broadcasted at a press circus.

I guess I can see it, although I would think there would be better ways to exercise pressure on other agencies to get involved other than throwing a press conference about it.

The Lawyer said the victim blaming has been devastating to his client. Her name hasn't been released, has it? Is it possible that Kane's lawyer might retaliate by releasing her name?

wouldn't either side's team of lawyers know/realize that the rape kit went missing at some point before the mother noticed it on tuesday?

 

would it be possible for a fake rape kit to be submitted as evidence? what a weird turn of events...

The photo her attorney released of the bag has her name on it, so I'm sure that he wouldn't have done that without her knowing.

Not to go all conspiracy theory but a cop friend of Kane's could have planted the fake rape kit at the mother's house so that the lawyer would look stupid when he tried to use it. The cops could then produce the actual rape kit and say "nope, here it is".

Why? It wouldn't be in their possession. Under normal course of events wouldn't they just assume it was sitting in a room somewhere? They aren't visiting it every morning.

There hasn't been an accusation.

 

The implication is that the people in charge of investigating/prosecuting the case, have done a poor job.

The other day they announced that the rape kit showed no Kane DNA near the victim's genitals. The lawyer for the victim is saying that the real rape kit was opened and thrown in the trash and replaced with the one that produced the results favorable to Kane's defense. That would mean that a law enforcement person tampered with the original rape kit, making tit inadmissible in court.

 

I think this really backfires on the victim. Unless they can prove that the real rape kit was tampered with they are going to appear dishonest and make it easier for those that want to defend Kane to feel better about doing just that.

That's the question. When did the alleged tampering occur? Before or after it was analyzed?

Doesn't this arguably screw over both sides? Isn't all of the DNA evidence now potentially inadmissible? Hell, if anything, this actually helps Kane; they already the leak about the lack of his DNA via joy juice; now the other DNA evidence found her is likely to be tossed as well. Edited by Sammy Sofa

Both sides can plausibly argue that it hurts them, and are doing just that.

If it was an SVU episode, it'd be too unrealistic.
