What is going on? Can't stream it. HFboards is as usual full of fanboys.

 

Biggest thing is that the DNA Rape Kit test was apparently torn open, found in a dumpster and mailed to the victims mother's house. Arent sure when it was torn open, but either way if its true this evidence is inadmissible in court.

I missed the first couple minutes but somebody dropped off the tampered with rape kit at the victim's mother's house, possibly as a good samaritan tipster. The implication is that somebody with access to the kit tampered with the kit in an effort to protect Kane and the victim's lawyer is looking for the Feds to come in and investigate a potentially shady police department and/or DA's office.

I'm just trying to figure out what the implications are. If they had evidence that someone related to Kane tampered with the kit, can that be used as probable cause to charge him? It doesn't seem like it.

 

If it was determined that someone related to Kane was found to be the one that tampered it, could Kane be charged with obstruction of justice?

I imagine they'd have to prove that he had prior knowledge.

The DA has not yet confirmed that the ripped open bag is the official rape kit evidence bag, but they are allegedly looking into it.

Theoretically, they could find the person who did the tampering and that person could implicate Kane in a case involving bribing, obstruction of justice, tampering with evidence, etc. etc. At that point, the rape trial may be the least of his concerns.

I would think the most likely scenario is that one lone wolf officer/official tried to help his buddy out. An attorney falsifying evidence evidence like that seems very unlikely to me.

The whole thing seems dumb and weird. A DNA test doesn't prove or disprove consent, so who cares? She could have banged half of Buffalo and still been raped. Wouldn't the better attorney-of-the-victim move be to say nothing in public? It smack of optics/damage control or something.

 

I dunno. It's far more likely than not Kane is guilty, but I don't see the endgame of parading a ripped bag out and calling a press conference about it. Wouldn't you have contacted the FBI first, or something? Shouldn't the prosecutor be involved at some point here?

So it's been tampered with, which means chain of evidence is in doubt, meaning it's inadmissible. The test itself doesn't prove or disprove consent, but if anything, Kane's defense team could have used the test as part of their defense. So now, it's not admissible and can't be used.

 

So some cop friend of Patrick Kane tampered with the evidence in order to trash the victim's reputation but actually just weakened Kane's defense? What sort of sense does that make? Hence, if I'm her attorney I handle whatever allegations behind the scene, not call a press conference and make half-assed accusations of impropriety.

i think us means why would someone on kane's side (or a cop or whatever) take the chance of tamperingwith it, given the implications of said tampering, when even a positive result wouldn't have been proof of rape

How does it benefit the victim's case to throw a press conference to complain in public (before handling in private) about some idiot criminal cop allegedly invalidating what would have probably been one of the core pillars of Kane's defense?

 

She can throw a press conference every day for all I care, but I don't understand why her lawyer is taking this particular approach. Why not go to the state police, or the FBI first, or say nothing in public, or say that the reports in the Niagra tabloid are false, or any number of things as opposed to an "I'm not saying, I'm just saying" press conference.
