I bet Walt Jocketty and Larussa have a press conference scheduled to annouce their support for Handcock's dad in pursuit of "Justice"

 

 

Whatta freaking joke, only the Cardinals.

 

Ummm, I bet they don't do that and there are plenty of people who filed frivolous lawsuits who aren't involved with the Cardinals organization.

Hey this is a big deal for Larussa, if Handcocks Dad wins maybe Larussa can sue whoever served him prior to his DUI.

I see a guy trying to profit off his son's death. Probably doing the same things he did when his son was alive, by blaming others for his kids' failings.

Lawsuit to be filed in Hancock death

 

Named as defendants in the wrongful death suit are Mike Shannon's, a popular St. Louis restaurant, and its manager; a tow truck company and its driver; and the driver of a disabled vehicle.

 

If the reports of Hancock refusing a taxi at the restaurant are true, then that alone should be sufficient grounds for dismissal of that part of the lawsuit. The restaurant did it's duty, Hancock refused. They can't force him into a cab.

 

As far as suing the tow truck and the driver, there's no legal justification for that suit. If the driver hadn't called a tow truck and had abandoned his vehicle, that would be different, but the driver took the necessary steps to protect his property and the property of others from damage the instant he called for a tow.

It was well documented at the time that Hancock was offered a cab.

I don't really see negligence on their part. He chose to drive. I'm sick of people blaming others for their own ignorance.

I'm acting like a dumbass irresponsible idiot endangered many lives and killed himself, and a father wants to try and blame others and make some money at the same time. That's what's happening right here.

I could care less if he is suing for 3 bucks. It is the principal that is disgusting. Suing the frekain tow truck driver and the owner who called the tow truck? Gee, if my car ever breaks down god forbid I call a tow truck because some drunk moron could hit it and kill himself. And that would be 100% my fault, because you know, you have to consider that right. :roll:

Yeah this sort of legal madness happens far too often in our country. I wish there was a way to stop it but our legal system allows anyone to bring suit for pretty much anything.

 

Hopefully they wind up getting nothing. I can only assume the ulterior motive here is to pressure the relevant parties for a settlement of some kind. Easy money.

What are you talking about? The only person who broke the law was Josh Hancock. The law may allow for pointless lawsuits that attempt to shift the blame, but that doesn't make it right. His dad can file suit against anyone for anything, but any judge with his/her head on their shoulders is going to pimp slap this into the circular file.

Sadly, I wouldn't be suprised if he got some $$$$ out of this. That is pretty much the norm in todays society. Quite sickening.

Well, it's not surprising Hancock's dad did this. People blame all sorts of weird things/people/events when they're grieving. The lawsuit is ridiculous. Josh chose to drink. Josh chose to drive. Josh chose to talk on his cell phone while driving. Josh chose to be in possession of an illegal substance. No one is to blame for this mess other than Josh Hancock.

I completely agree with the sentiment that it's utterly ridiculous of the father to go on a lawsuit-spree, but the suit against Mike Shannon's has legs. If it Hancock was obviously and visibly intoxicated while he was being served by Shannon's employees, then I think it'll be an open and shut case in favor of the father, and it'll probably be settled out of court. I wouldn't be surprised at all if the final settlement is in the 10 mil range.

 

The suits against the tow truck driver and the driver of the disabled vehicle should be laughed out of court, but I think the dad wins the case against Shannon's if there's a grain of truth in the several eyewitness quotes in the media that Hancock was nearly incoherent.

 

Given Shannon's long-time close association with the Cardinal organization, I'd be surprised if TLR, Jocketty, etc don't distance themselves from this debacle. 'No comment' is the only reasonable response.

There was no negligence on the bar's part. They may have served him more alcohol than would allow him to legally drive but went the extra mile to offer him a cab, more than one time if I recall correctly. There is absolutely no way on God's green earth a sane and logical person can possibly think the bar is in any way at fault on this. Man, irresponsible litigious people just piss me off.
