Let's see if Manny tries to overturn his suspension now. All he needs to do is hire some really expensive lawyers to find a loophole or technicality and he's good to go.

The loophole technicality sucks. It'd bother me more though if we were supposed to contend. Edited by davell

Granted, this is the better scenerio for the 2012 Brewers, but in the long run, what's worse for Brauns reputation: Decision upheld, 50 game suspension or decision overturned due to technicality plus herpes rumors.

 

It's the one where he misses 1/3 of a season for breaking MLB rules.

Yeah, but everyone still knows he's a cheater. He's lost in the court of public opinion, which is pretty important. You find someone with 10 kilos of cocaine, you know he's a drug dealer, regardless of whether the evidence gets tossed due to a technicality. So the Brewers win a few more games. The Cubs aren't going anywhere this year.

So the tester, instead of FedExing it immediately, took it home and refrigerated it.

 

Huh?

Apparently if he'd just dropped it off at FedEx, even though they weren't delivering at the time, the failed test would have stood up. This is nuts.

MLB voted to suspend him for 50 games and "vehemently disagreed" with the ruling.

He's a cheater that got off on a BS technicality. His numbers will drop this season.

 

That will probably be blamed on the "unfair scrutiny" he received.

Of that Fielder is gone or antisemitism. He'll find something else to point to I'm sure.

I think how open MLB is about disagreeing is more than a little out of character for them. The way I would expect them to handle this would be to say something along the lines of a fair judgment by an impartial 3rd party has ensured the proper carriage of justice. "Vehemently disagreeing" is pretty much the PR equivalent of throwing a complete tantrum. I find a reaction so far out of character at least a little suspicious.

It might be because this appeal opens a can of worms for future players who fail a test.

I'd say that MLB voting against him in the first place without knowledge of the 3rd parties decision is enough to take their reaction seriously.

Listening to sports radio today, and they brought up an interesting point: this may not be the first PED suspension that was overturned, it's just the first one that was made public. Braun's failed test wasn't announced by MLB, it was leaked to the media. Braun could have chosen not to respond to the allegations and dismissed them as rumors. Either way, there may have been one or several other failed tests that WEREN'T leaked but were successfully overturned

I'm pretty dumbfounded every time I read a comment in an article by someone who remains anonymous for self-described reasons of not being authorized to speak on a given matter or because something is too sensitive to discuss. I can see the value of someone doing that if it's in an effort to provide transparency or accountability where they feel they they are part of a system which is being unfair, yet they don't have any other options for recourse.

 

But I can't imagine the leak of this case was motivated by anything other than ZOMG RYAN BRAUN STEROIDS!!! and possibly (almost certainly) some money from whatever news outlet they leaked the story to.

It's going to be really annoying listening to Brewer Fans adamantly claiming Braun is clean because he didn't get suspended.

It's already begun...just go to brewerscubs.

 

Its unbelievable how people believe what they want to believe and ignore the facts....aka Penn State fans. How do Brewers fans claim Braun's innocent when he didn't challenge the testing result, but the process instead?
