Civil suit announced in 3....2....1...

 

I doubt it. The prosecutor basically all but said Kane didn't do it...

 

"The totality of the credible evidence -- the proof -- does not sufficiently substantiate the complainant's allegation that she was raped by Patrick Kane and this so-called 'case' is rife with reasonable doubt," Sedita wrote in a statement released Thursday.

 

Sedita said the reasons for dropping the case include "significant material inconsistencies" in the accounts of the accuser and other witnesses, and that physical evidence tended "to contradict" her claim that she was raped on Kane's bed.

 

Inconsistencies and contradictions...those aren't "maybe he did it" words.

reasonable doubt isn't a part of the civil suit though, correct?

 

Correct, it's a "preponderance of the evidence"...and while I'm no lawyer, from what the prosecutor said, it doesn't sound like that even exists here.

So no matter what the actual facts of the case are, Kaner must be guilty of rape because he's a douchebag? And by suggesting that he may not have raped this girl that makes one a moron and hater of all thing female?

Sure seems like most people here refuse to believe that maybe, just maybe Kaner didn't rape the girl and that anyone who believe that only does so because he is good at hockey.

I honestly haven't put much thought into it other than seeing texts from my brother who insists that Kane is guilty because he paid everyone off while refusing to read anything the prosecutor said. I've said if Kane is guilty than he needs to be punished to the fullest extent of the law. This situation has honestly taken away a lot of joy from hockey season so far for me. I wanted him to be innocent but I never hoped he would get off on a technicality. I don't really even know what to think about the situation right now. But the jackasses on both sides of the issue who are 100% right in their minds are insufferable.

The DA said he couldn't prove that anything happened. I think a lot of people are taking that and spinning it however it best supports their opinion. I feel like something bad happened to her and Kane was in some way involved. Which brings us right back where we were several weeks ago when Gooney said (I'm paraphrasing) that we'll never really know what happened but Kane should never be admired again.

*shrug* I think he probably did it. Most people who are accused did. This is how I always expected to end, because outside of extreme cases these things are essentially impossible to prove. I'm never going to look at Kane the same way, and I haven't been watching the Blackhawks this year because I don't feel like rooting for him. I'm sure I'll get over it by the second round of the playoffs, and assuage my guilt with the possibility that he didn't do it.

Nope, if someone is accused of doing something wrong by someone who is lying about it, they're a victim. Although we have no idea if Kane is guilty or not.

The report I saw on CSN about how the DA characterized the case seemed to go even beyond the quotes that were posted here insofar as putting the validity of the accusations into question.

 

Among their findings:

 

• There are significant material inconsistencies between the complainant’s accounts and those of other witnesses.

 

• The DNA results lend no corroboration whatsoever to the complainant’s claim of penetration, a required element of proof for a rape charge.

 

• The physical evidence and the forensic evidence, when viewed in tandem, tend to contradict the complainant’s claim that she was raped on Kane’s bed. Although Kane has exercised his constitutional right to remain silent (which prohibits questioning by law enforcement), he has made no known incriminating statements to any civilian, nor has he engaged in any conduct consistent with a consciousness of guilt.

Not to mention the "eyewitnesses" with conflicting stories are said to have been bar employees who give a different version of events while they were at the bar than the alleged victim. It doesn't matter what happened at the bar. She could have gone up to every single person in the bar and said I want to have sex with Patrick Kane tonight and the end result could have been that a rape occurred.

Unfortunately, nobody is ever going to know exactly what happened except Kane and the woman. Whatever did happen was enough to cause her to immediately go authorities, which is the correct response to a sexual assault and extremely hard to do for someone recently traumatized. For that she gets her identity released and gets constantly harassed by strangers with no business being involved, and the only way to make it stop is to disappear.
