There's a whole hell of a lot that could be done in the best interests of baseball that Bud does not because the legal ramifications and/or the fallout from interfering with an owner's business is too huge. Why the hell would he interfere here? It makes no sense.

 

That's just it: The legal ramifications aren't as bad as you think. Before baseball let's someone buy a franchise, they make them sign a bunch of paperwork agreeing that the commissioner has broad powers and that they won't sue MLB no matter what.

 

They'd sue anyway, of course, but so far that power has held up in courts thanks to the anti-trust exemption.

 

Whether or not he would interfere is a whole other story, but it's clear he has the power to interfere if he wanted to.

So was Hoyer under contract to SD? If so, do we owe them any compensation?

Moorad and Ricketts are buddies. Moorad loves Byrnes. Therefore, Moorad will not stand in the way of Hoyer coming to the Cubs, thereby allowing him to promote Byrnes to GM.

Yeah, and when you go on a field trip at school they make you sign paperwork saying you won't sue if you get hurt. The commish is only ever going to interfere in the most extreme circumstances because the legal entanglements that will ensure without a slam dunk case (the Dodgers) would be too large to make it worth it. Plus, the fallout from other owners who don't like being told what to do. This isn't 1932. The owners are billionaires with all the real power. Bud is their front man. He's not an arbiter of all transactions.

No, I'm not disputing that. Selig just used it because McCourt is running the Dodgers into the ground. What I'm saying is that it does not apply here. This is a simple trade negotiation between two members of the club. If one side is being obstinate the Commissioner has no authority to make that side be reasonable. It goes well beyond his job. He can bitch about it and say come on boys lets be reasonable here, but his job is to speak for all the owners. If he sides with the Red Sox or Cubs imagine what would happen. The other owners would not stand for it.

 

First, you are correct, Selig might not exercise his authority because he's concerned about the consequences. However, merely because he would not does not mean he could not.

I'll buy that. It's not an academic exercise. Bud is not Judge Landis. He can't even get teams to stop paying draft picks too much money.

What I don't get is the assumption that if Selig were to get involved, that he'd mandate a solution in the Cubs' favor.
