I've seen it misrepresented a few times in this thread and elsewhere. It's important to note that her "coming to" doesn't necessarily mean she was passed out, I take it to mean came to from the blackout. There's a huge difference between having sex(or whatever they were doing) with a blacked out girl and a passed out girl, especially if Castro was drunk as well.

More often than not, if you black out the most unfortunate thing that happens is your buddies drawing on your face and/or taking embarrassing pictures. When people are simply drunk, especially when they're more drunk than they realize that's when these unfortunate things are likely to occur. I'd be willing to bet that most people who have been in a drunk driving accident, given a DUI were not too drunk to make it home safely in their mind. When a night out ends in a fight leaving someone dead or hospitalized, I'd be willing to bet that they weren't blacked out and were simply drunk. It takes a particularly sick individual to take advantage of a woman when she's blacked out.

Blacking out and passing out are two separate things.

That's how I'd define it. When you are so drunk you lose time, you're probably compromised to the point that you'll do far dumber [expletive] that if you were just drunk. The handful of times I did that to myself I usually had to endure some account of something embarrassing and/or dangerous I had done the night before.

 

Now if this girl was in that state, what happened is at least in part (or totally) her own fault. You can't blame other people for the stupid stuff you do because you can't control your drinking.

 

Now the problem becomes determining whether she was conscious or actually passed out.

A girl who is passed out is unconscious.

A girl who is blacked out is drunk, (like you), but doesn't remember what happened. There is no way to know with certainty whether someone is blacked out.

The problem is that you can't always tell if another person is "blacked out", especially if you are also drunk. A person might be awake and simply presenting as drunk but have no memory of events the next day.

 

If the was unconscious or nearly so, that's a different issue.

 

Of course not having sex with really, really drunk girls at all is probably a pretty good policy.
