this sounds like a job for kyle, there's no way he has enough of a life not to do this. he goes on vacation to chess tournaments for God's sakes.

 

Someone woke up on the wrong side of the globe this morning.

 

seriously though, if you figure this out i will call him and yell at him and tell you guys about it

Before all of this, I was very indifferent about the Red Sox. Now I can say that I dislike them for being this ridiculous about a situation that THEY created with Epstein. He has wanted out because of a perceived lack of appreciation from Lucchino. John Henry then states he will allow Epstein to go (or talk) if it's a non lateral move.

 

The Cubs offer Theo just that and now they play hardball. We are trying to be fair but they are just being awipes about it. I hope Ricketts remembers this in future dealings with these pricks.

 

I'm on the "in favor of the Cubs playing hardball" side - but show me where he stated this.

 

 

There's a certain protocol in this game if someone asks to interview somebody that is not just a lateral move," Henry said.

and i'm just saying that a guy who will e-mail north dakota state university professors and indiana radio announcers to settle message board disputes should really be able to solve this one.

This is interesting because it indicates that the Red Sox are going to (or already have) granted permission because the job is a step up for Epstein. In other words, it seems that if Theo comes to the Cubs, it will not be just as a GM, he will have an additional title -- probably President of Baseball Operations. This is something Epstein won't get in Boston and it represents an opportunity that he is known to be interested in -- especially with a team with the resources that the Cubs have.

I'm very impressed with the way the Red Sox have manipulated the local media to be their attack dogs against anyone they have a grudge against. I hope Theo can bring that skill to Chicago.

I'm impressed by how Boston, standing in the still-smoking ruins of a season with napalm continuing to reign down on the team, former manager, and ownership, thinks that bad P.R. will force Ricketts' hand.

Still, granting permission doesn't at all imply anything about an agreement on compensation or that they'll agree to allowing the person out of his/her contract easily.

 

In fact, he didn't even really come out and acknowledge that what the Cubs are offering is a non-lateral move (which is, to some extent, a subjective matter of opinion), though it's likely that they, at least somewhat, agree that it is.

I personally don't know the ins-and-outs of contract negotiations, especially ones to this degree. However, if the Sox cause considerable monetary loss (not to mention stalling career path growth) to an employee because they deny that employee from taking a job with the Cubs, I think that employee has litigation rights to help himself to that lost compensation. I may be wrong on that though.

Of course you're wrong. Epstein signed a contract with the Red Sox to be their GM. He can't turn around and sue them for asking him to honor that contract.

 

I'm not saying that the employee is entitled to some type of compensation. Merely that the employee may plead his case that he should be entitled to compensation. If that employee can prove that the decision to retain the employee was not a business decision (IE: spite), I would think there is a case there. It would be very hard to prove, but the way the Red Sox organization have been smearing Epstein, I would think there's at least a threat for litigation.

And I'm telling you there isn't.

 

 

I don't think there's anyway you possibly know that for sure off the top of your head.

A rudimentary understanding of employment law and contract law is all I need to know.

There are 497 buildings in the city of Chicago that are 19 floors or higher.

Really? I think exactly the opposite. It is has been a bi-polar operation on their part. Meanwhile, Ricketts and Co. have been calm throughout, refusing to get flustered by the Sox strange negotiation tactics. Add to everything, this recent article by the Globe and it makes the Sox look even more pathetic.

You think compensation would be equal for a lateral move compared to a promotion? Nobody's arguing there should be no compensation involved.

You're right in the way you worded it. I specified a situation that may or may not allow for legal action that you're ignoring so that you can be right though.
