  5. That's just it: The legal ramifications aren't as bad as you think. Before baseball let's someone buy a franchise, they make them sign a bunch of paperwork agreeing that the commissioner has broad powers and that they won't sue MLB no matter what. They'd sue anyway, of course, but so far that power has held up in courts thanks to the anti-trust exemption. Whether or not he would interfere is a whole other story, but it's clear he has the power to interfere if he wanted to.

  9. If he sided with one or the other, it would be sided. He may choose not to do it because he wants to maintain balance between the owners that hired him, but that does not mean it is not within his authority.
  10. I don't have a copy of all the agreements between MLB and owners, but it's come up quite a bit in baseball history.   12. I don't think that is correct. He works at the pleasure of the owners. I don't think the rest of the owners would take kindly to Bud siding with one party or the other like that. There is no "best interest of baseball clause here". This is a discussion among two members of the club. Whether you think it or not, this really is correct. He has the authority to say tomorrow "I find that Epstein going to the Cubs is in the best interests of baseball, and if you don't do it, I will revoke your franchise." It's the ultimate nuclear option, because it torches franchise value and the owners would vote to fire him the next day, but it's still within his authority.
  13. Selig has the power to strip the Boston owners of the franchise on a whim, and they likely signed an agreement when they bought the team that they wouldn't ever sue him, even if he did that. He has broad powers. He may not want to use them, but he definitely has nearly infinite power within baseball.
  14. Yes and possibly. But the thinking right now is that SD won't ask for any compensation because they are happy with Byrnes, Hoyer wants to go back to the Midwest and Hendry/Moorad are best buddies.

  17. I also can't imagine him going back to work there either. That's why I think it will happen. It will take as much time as Henry can drag out of Ricketts. It's a huge PR mess for them. Dragging this thing out is about the only face saving gesture they can do at this point. After it's over they will sling mud on Ricketts and Theo and hope the masses buy it all. I mean legally they can't keep him under contract and prevent him from fulfilling his duties. I assume his contract gives him pretty broad baseball decision authority that they'd need someone to use. They can't just usurp that without letting him go one way or another. At some point, it was brought up by someone that Epstein didn't include a lawyer and negotiated his own contract with the Red Sox, so maybe that language isn't in there. Or maybe it is. Who knows. This is the kind of thing that would be reported on if we had remotely competent sports journalists in either town.

  22. Good. Keeping the overslots in place is worth at least 1.2 Marginal McNutts in AAV for the Cubs.
  23. The reality is Ricketts has given the go ahead to essentially sign as many over slot guys as possible in the draft. Just by doing that our chances of stocking up the farm with top prospects significantly increase. Overslots may not be around for much longer. I really hope that Selig can't push that through, but I suspect he might.
  24. Sure. But what if the Cubs hired someone like Cherington or Hahn instead, but still made a major investment in the draft and IFAs like this year. How many marginal McNutts is Epstein worth over the next, freely available option?
