Not only is he not on the 40 man, he isn't a member of the Player's Association until he plays in a Major League game AND files paperwork to become a member. But yeah, the 40 man has literally nothing to do with Union status. Here's the thing...the rule exists to protect guys that Boras already represents or represented at the time it was agreed to in the CBA, in the Majors. So Boras, while a great agent and the guy I would want representing me, is talking out of both sides of his mouth and literally nobody calls him on it because the media is just enthralled by him and honored to be in his presence.

Q: Who is eligible for membership in the Association?

A: All players, managers, coaches and trainers who hold a signed contract with a Major League club are eligible for membership in the Association. In collective bargaining, the Association represents around 1,200 players, or the number of players on each club's 40-man roster, in addition to any players on the disabled list.

It's still completely bizarre to me that Jim Edmonds was once a Cub and [expletive] raked for us. That was fun.

 

Most of the "Edmonds is a weirdo" stuff was just because he was good and killed us. We called him guyliner for god's sakes

 

The guyliner and half-shirts suck, because they are rightfully mocked for looking TERRIBLE, but at the same time it gives ammo to the worst kind of fans who are just gonna call him a "[expletive]" and [expletive] over it. Which actually Edmond even more terrible that he can't be mocked properly for his atrocious fashion choices.

I was always conflicted about the half shirt thing because I wore one under my football pads so I couldn't mock him- but definitely wanted to hate him.

 

But then he became a Cub and played awesome so I could love him and half shirts.

Even though he's not playing today, here's my Bryant stat of the day:

 

Counting only HR, he's batting .320 this spring.

he is fun to watch but i am very surprised to see he does that michael barrett thing where he fidgets with his glove instead of giving the pitcher a target before the pitch.

That was fun to watch, as was Maddon being too close to the mic (and Rizzo's epic f-bomb), but man, the Cubs's offense has looked like absolute [expletive] in every ST game I see. I feel like they're doing it on purpose to spite me.

Bryant doesn't have a MLB contract because he's never played in an MLB game so he is ineligible to be represented. And he won't be on the 40 man until he's called up. So, I don't see the Union's stance as strong but I am not a lawyer. It's the same reason that players can't be added to things like video games until they play in a game and file paperwork, regardless of their status on the 40 man, this is because they are not part of the union yet. For a player who has been called up then sent back down it matters but in Bryant's case it does not. I guess I just don't see the Union's end game here because the CBA is agreed upon by the Union and their lawyers and the players and teams use what they can. If the Union wants to renegotiate in the next CBA and put some language that is subjective with regards to milestones a minor leaguer has to hit and then require the team to call the player up then I could see them having a case. But again, I'm not a lawyer, I just don't see how the organizations will negotiate a way that will leave their roster decisions in the hands of an arbitrator.

You are arguing with the MLBPA's website here. If you are on the 40 man you have a major league contract. Shark was on the 40 man when he signed with the Cubs thanks to Hendry and had a major league deal.

 

Since Bryant isn't on the 40 man he's not represented by the union. My guess here and it's just a guess, is that the if the union would file a grievance after he's called up it wouldn't stand as its sort of catch 22 (he can't be in the union until he's on the 40 and when he gets put on the 40 man he'll likely be in MLB so there is no union representation while he's in the minors).

It's what...12 games? I highly doubt the Bryant/Cubs relationship would be damaged. This is a blip on the screen.

 

It's not the 12 games that's a concern, it's the extra year Bryant has to wait to be paid fair market value.
