Roughly a week before pitchers and catchers are due to report to spring training, the Herald has learned today that right-hander Curt Schilling has a significant shoulder injury that could end the veteran right-hander’s season and is causing tension and friction between the player and club.

 

While neither Schilling nor Sox officials could be reached for comment, baseball sources have indicated that the club has at least inquired about the possibility of voiding the one-year, $8 million contract Schilling signed last November. It is not known to what lengths the Sox have gone on the matter, but their threat has been serious enough to create a conflict between Schilling and the Red Sox.

Why are the Red Sox fighting? Wasn't this deal insured? This really shouldn't cost them a dime. Don't get me wrong, I can't wait to see the infighting. However if the SAWKS didn't insure this, they are inept and I will love it!

The news on ESPN (scrolling at the bottom of the screen during the IU-UI game) indicated that he was expected to be out until the All-Star break. He reportedly has a partially torn rotator cuff, although he's denying it.

Hey, this point actually helped me study for the CPA, because I had to look it up.

 

The tension probably comes from a question of when it was that Schilling knew about the injury. If he knew about it or should have known about it (e.g. he had horrible pain for a month but intentionally didn't go to the doctor) before he signed the contract that is "fraud in the inducement" and the Red Sox have the right to cancel his contract. Even if they chose not to, when the Red Sox insured his contract it would have been with the warranty that Schilling was healthy as of that date. If it turns out he wasn't, by law it is an "innocent misrepresentation" and gives the insurance company the right to rescind the policy.

 

I should add, though, that this is just general contract law. There is certainly a chance there is some baseball exemption, as MLB has a lot exemptions.

i always knew schilling enjoyed eating wieners and playing everquest. in fact im sure this "injury" is more about him needing to level up his EQ characters more than baseball.

 

He has $2M in incentives for maintaining his weight in his current contract, and there have been rumblings that the Sox think some of his injuries last year were due to him coming into the season out of shape.
