Is this the only way to have an avatar, because i notice a lot of users have new avatars on what seems to be a weekly basis yet aren't under the userpic avatar list...

Since the switch to PhpBB3, Premium doesn't currently exist. I'm sure Tim will provide more updates when his schedule allows him to "recreate" Premium under the new board.
