If anyone is interested:

Prosecutors say Castillo was attempting to hit a Dayton player in the dugout, but instead struck the fan in the head. Montgomery County Prosecutor Mathias Heck Jr. has said Castillo threw the baseball to purposely hurt someone, putting spectators that included children in danger. Defense attorney Dennis Lieberman has said the charges aren't justified by the circumstances.

"He obviously threw the ball," Lieberman said Monday. "But for it to be a crime of this nature he would have to know he was going to cause serious physical harm. We don't believe that's the case."

Thanks.

He's still in the Cubs organization and was throwing side sessions at extended spring training.

What's the old saying... intent follows the bullet?

If I were him I'd be looking for a plea.

Castillo, 22, is from the Dominican Republic. He remains under contract with the Chicago Cubs, who are paying his legal bills, but has not played since the incident at Fifth Third.

That sucks. I wonder if the Cubs were obligated to pay his bills since it happened while Castillo was "at work." If not, the Cubs are certainly doing that man a huge favor.

If that were the case, Valerio de Los Santos would have had a trial.

Legally speaking, it's a close call. And not very interesting. But it depends on whether what he did was considered "within the scope of his employment," basically. It's a broader definition than you might think, which is probably why they were paying for his defense.

Interesting insight - thanks!

I like that the judge involved working towards at GED. I personally believe all the players should do that not just in the Cubs system but all systems if they didn't obtain the equivalent in their native country. Its amazing how little some of these guys can communicate. Some can't even participate in autograph signings or community events because of their struggles with the english language.

And I know its kind of comparing Apples to Oranges, but isn't this the exact same sentence Dante Stallworth got for his DUI when someone died?
