Truth is a defense to defamation. What does this mean in practice? By filing this claim, Bonds exposes himself to all types of discovery from Shilling geared at determining whether Bonds in fact used steroids. It won't happen.

You'd think at this point Barry would just want to drift into oblivion and never be heard from again - at least since he claims he hates the media attention etc...

 

Despite anything that ever happens, the "court of public opinion" will forever see his career and record as being tainted. The fact that Greg Anderson prefers prison to testifying about Bond's use or non-use of steroids imho is all the proof I need that Barry was doing something he knew was wrong - if there was nothing to hide, why sit in prison?

 

If Bonds ever has a falling out with Anderson, that's when the full information will come out - my guess is Barry will be funding the rest of Anderson's life if not.

 

Personally I'm tired of him and wish he would just go away.

Well, couldn't Schilling just say he testified that he unknowingly took roids. Then it would be up to Bonds to prove that he didn't say that. I don't know...it's all stupid.

Just bring a copy of Game of Shadows. Case dismissed.

 

This is just a ploy anyway, to try and scare anyone else who might be thinking of speaking out against Barry. Nothing but some intimidation to try and silence the very real criticism that Bonds doesn't want to have to deal with anymore.

Man Barry does think he is innocent. He has fooled himself. But we must remember that Bonds did sue the authors of "Game of Shadows" only to revoke it once the government began their case. One the one hand it looks like Bonds is trying to cover his butt, but on the other hand it gives him a touch of credibility. Wait, did I just say that. This is really what Barry does not want. The only thing that could make him look worse is if this somehow went to trial and we come to know in a court of law that Barry did knowingly take steroids.

The best thing Bonds could do for himself is put some duct tape over his mouth permanently the next time he puts his armor on his left arm. I've never witnessed anyone so talented, so strong, and such a complete jerk and crybaby at the same time.

i hate curt schilling like most baseball fans hate barry bonds

 

Word.

 

He talked to talk, but he certainly did not walk the walk when it came to the steroid hearings in Washington. I lost a ton of respect for him that day.

I wasn't aware that Bonds's grand jury testimony had been unsealed.

that's what confuses this non-lawyer: we know that schilling is innocent, but as far as I can tell, he can't use the sources of his knowledge as a defense.

 

On the other hand, American trials of this sort (unlike British) put the burden of proof on the prosecution, which is why all those libel suits by terrorism supporters and such take place in the UK

You can't use leaked grand jury testimony in court. It's sealed, no matter who leaked it, it's still sealed. It simply can't be used in court.
