  1. In a million years, I don't know how you could differentiate between "kicking dirt" and hitting the gas to try to swerve away from the sudden appearance of an obstacle. Maybe you can't - I'm not an expert on the behavior of motor vehicles. My point was that the notion that he can't be prosecuted absent evidence of intent or because he wasn't on a traditional road is absolutely incorrect. I think you're talking about evidence of intent to kill him and others are talking evidence of intent to do anything wrong (i.e. anything other than race or try to avoid hitting a guy if he saw him) I can't imagine that he could be prosecuted for anything absent evidence of intent of ANY wrongdoing That's an interesting philosophical idea (no sarcasm intended). From a legal standpoint, he can argue that he didn't mean to do it, but if he did something negligent or reckless relative to "normal" operation of the vehicle, he is likely criminally culpable for the result.

  3. Call it vehicular manslaughter or plain manslaughter, it doesn't matter. If he intended to spin his wheels in order to kick dirt at him or intimidate him, he could be criminally culpable. Expert analysis of the video (behavior of the vehicle) should give the prosecutors an idea of what happened. It's not that difficult a concept.

  7. The reports I have read indicate he isn't facing charges "yet" and that the local prosecutor is consulting an "expert"(presumably on how these particular machines behave when operated). There's no statute of limitation on a murder/manslaughter charge and there is no upside to charging Stewart right away; he's not a flight risk. Better to have your ducks in a row. Stewart is not out of the woods here at all. By the way, his initial reaction smacked of callous indifference to the situation and/or a naive attempt to distract the general public from his potential culpability. It was a sort of, "Oh well, these things happen on the track. See you tomorrow!"; when in reality he was thinking, "I need to act like I did nothing wrong and hope people will buy it."
  8. Yeah, probably need to stop that. Guys without positions need to have absolutely elite bats. He has never put up elite numbers. Probably not going to at this point. He's not elite. But as part of a larger package that includes Johnson, Almora, and another piece he is worth something.
  9. To me, Soler, Bryant and Russell are pretty much untouchable. I like Tim's idea of Vogelbach. Almora and P. Johnson. I'd include Hendricks as well and ask for 15-20 mill or so in addition to Hammels.

  12. I am really excited about Stinnett. 97 MPH cutter? Thats filthy. Outlaw Curve Ball! I count half a dozen likely 3rd-5th starters in their top 25 (including Hendrickson). Nice problem to have. Maybe I am delusional here, but Black sounds a bit like Arrieta.

  14. Yeah, the idea here is to acquire as many high-value / likelihood of success position players as possible, regardless of where on the field they play. You don't have to start clearing space for all of them immediately or even soon.

  18. I go back and forth on this. Its a pretty crowded perimeter in Cleveland right now between Irving, LeBron and Wiggins...can they all play together and space the floor appropriately? Do you need balance up front? LeBron can play in the post MJ-style to be sure, but is that the best use of his skills?

  23. They got a solid starting caliber player for next year for 2 months of Lester on a last place team and a jonny gomes that has been awful. Why is it amazingly terrible? Because I think Lester is worth more than 1.2 years of a marginally above average OF? You don't seem to be taking into account that Lester is a free agent who will be leaving this year while Cespedes could easily be more productive out of Oakland and kept by the Red Sox longterm.
