  1. The thing anyone should infer about him not suing for libel is that he has good legal advice. Give this man/woman a star. Even if he won, he'd spend millions and be in for a very nasty battle, not to mention drawing further attention to the issue. I frequently advise clients on unfair competition issues (which has some similar implications and issues), and tell them exactly the same thing.
  2. It's not that hard to improve on what we did last year, Rocket. Do you remember the countless AB's where there were RISP, and whoever was up there would get anxious and swing at the first pitch and hit into a double play? All the friggin time? Good point. Sort of makes me think that walks and "clutch hitting" go hand-in-hand. The more patient you are in your approach, the more likely you are to walk and/or get a pitch you can drive.
  3. i don't think this is true. i think the burden of proof is actually on bonds, and bonds has to prove malicious intent, which he almost certainly can't, whether he took steroids or not. I'm not a lawyer but I'm guessing malice is not relevant in the case of true statements. Plenty of malicious statements have been printed about Josef Stalin, who has living relatives, but you can be sure none of Stalin's relatives will ever sue for libel because the malicious statements about him are true. i guess i worded that badly. malice definitely is not relevant in the case of true statements. The general rule is that dead guys cannot sure for defamation - be it slander or libel.
  4. That is completely incorrect. See this link for a good general synopsis of what is required to prove a case for libel in most jurisdictions: http://www.mobar.org/handbook/libelelements.htm
  5. A fair and balanced assessment. Nice job.
  6. No. You can find guys like Texieria---not necessarily switch-hitting---who can hit a ton to stick at first base. But guys like Prior don't come to your organization that often. So I doubt the Cubs "regret" not taking Tex. Not that this is a big deal, but the quote you attributed to me above was not something that I wrote. Just for the record.
  7. Bingo. Hasn't he been head and shoulders above Hill, Guzman, Ryu and Williams? Again, there must be a good reason for this; I think Raw's reasoning above is the best I have read thus far. The future sure looks brighter if Ryu, Guzman and Marshall are all the real deal. Its a nice problem to have.
  8. The papers are saying he's put his best foot fwd, but it does not seem like they are seriously considering him as a potential no. 5. Can someone with greater knowledge of his history tell me why? Or is it b/c of his shoulder troubles of last year?
  9. The "forcible injenction" thing is brilliant.
  10. As Cubs fan since age four (1980 was my first game; I've followed them closely ever since), I appreciate your sentiments. That said, Dusty deserves a heaping dose of crticisim for how he has handled several situations, some of which are noted above (I don't agree with all of them. For instance, the notion that he rode Prior and Wood into the ground in 03' still bothers me b/c I've never seen proof of that hypothesis, and Prior really hasn't had serious arm trouble (pending the outcome of his current issues). Moreover, does anyone remember who was available in the 'pen in those games? Most often it was guys like Veres and Guthries. Ouch.).
  11. I'd trade him Pie, Walker and Hill for Cordero and Soriano. What do you think, Mr. Bowden?
  12. People don't have a problem with that. They do have a problem with you blasting others for sharing their doubts. You can have whatever opinion you want about Cubs management. Those who disagree aren't going to bombard you with BS akin to your Chicken Little crap. It's when you blast the posters who don't have faith in management for not having faith in management that people will have a problem with you. Share your opinion without labeling those who disagree with the absurd Chicken Little garbage, and similar trash, and there won't be a problem. I dunno about that. Its happened in the past, particulalry during times when we are all frustrated by some turn of events.
  13. I just thank Kenny Rogers that he did not contract Scarlet Fever:
  14. Wasn't that Doug Jennings? And don't forget Derrek May.
  15. I understand that you are bitter ad peeved at the refs, but your boys also completely ran away from their offense in the 2nd half.
  16. I am one sad Great Dane (Albany). :( Also proud as hell of those guys. Gave UConn a heck of a run. =D> Hail Alma Mater! :salut:
  17. I don't know about Zambo. Wasn't he in the system before Hendry came along? Who signed Zambo? Wasn't Jim Director of Scouting when he was signed? I dunno, I am just asking.
  18. This is ignorant. Because people disagree with you about Hendry, they must have something personal against him? Please. Talk about tired, old arguments. Jim Hendry has done many positive things for this org. & pessimists like you always bring up his shortcomings, without ever bringing up the positive things he has done. Pessimists always focus on the negative & there are tons of them on this board. Excellent post Ryno Rules! You might label me a pessimist if you saw my posts in the Prior thread. Different opinions on different issues. Just b/c the Prior thing is an absolute disgrace doesn't mean that Jim has not had his moments. Problem is its been a while since he has had them.
  19. This is ignorant. Because people disagree with you about Hendry, they must have something personal against him? Please. Talk about tired, old arguments. Wrong. Your arguments were dissecting those trades to the point where they made Hendry look like Maxwell Smart or Inspector Gadget - a bumbling fool who luckily has good results drop into his lap. That's my take on your argument, and I disagree with it. Hendry is far from perfect, and certainly deserves to have his feet held to the fire for things that have occurred over the last two or three years, but lets be fair. And I am far from ignorant.
  20. C'mon now, there was absolutly no way to accurately predict what in fact happended with Nomar, particularly last year. The Lee for Choi trade was excellent. The Hill et al. for Ramirez and Lofton was great. Hundley for Karros and Grudz was also well done. Hawkins for Williams and Aardsma was more than we should have gotten for a "bleh" pitcher. I agree that JH has not done much of anything since the Nomar deal, and I am upset about it. But that does not mean that he does not deserve credit for his better moments. This is an old argument on this bd., but some of us either see theglass as half empty all the time, or just have it in for Jim for reasons unknown.
  21. Thank you. :offtopic: Getting back :ontopic: : You trade Barrett b/c his value will never be higher (he's a 28-yr-old catcher with pop) and he has a reasonable contract, and you trade Jones b/c he has no purpose here if we blow the thing up (come to think of it, what purpose does he have currently?) and may have a bit of value to a veteran team in need of a fill-in in RF.
  22. If this goes to hell this year, and assuming that Dusty is not asked back, I think we should toy with the idea of blowing this thing up. Keep Lee, ARam, Prior and our young arms (Guzman, Hill, etc.) and put everyone else up for sale. Jones' contract is tradeable. Bring Pie up for 07', pair him with Matty in LF. Let Cedeno play SS. Bring up a kid to play 2B. Barrett has a lot of value - trade him too. Just blow the damn thing up!!!! :wall: :wall: :wall:
  23. Without getting into name calling or refering to certain emoticons as "lame", I think comparing Hermanson to Wood and Prior is like comparing a 2000 Accord to a 2006 BMW. In other words, they are not comparable. A better comparison would Hardin to Wood/Prior, or Felix Hernandez to Wood/Prior.
  24. True, but I think he deserves credit for giving the Dusty the benefit of the doubt, but not forever. His last sentence in this morning's column synthesized the issue very well - Guillen's SPs through more than 120 pitches 5 times all of last year. Guillen understands how to manage his assets; Dusty does not. Well said.
