I've heard you can be a 4 seed and lose homecourt to a 5th seed (which seems to defeat the purpose of seeding) or similar stuff. The top three seeds will be determined only by overall record - not by division. After that, any division champion not already seeded will be seeded. For instance, right now, Detroit and Cleveland would be 1 and 2, and Toronto would be seeded 4th because they're leading their division. And, yes, the record thing is true, too. The Bulls have a better record than Toronto so they would have homecourt in the 5/4 series even though the Bulls would be 5.
