In Miss. we likely would have charged him with felony Simple Assault which is putting another person in fear of imminent serious bodily harm. fwiw, I just looked up misdemeanor Third Degree Assault in Bama and what he did doesn't fit this statute: Pretty weird, none of the assault statutes in Alabama include scaring the isht out of someone.
